: james holmes stared straight ahead as prosecutors charged him. >> 24 counts of murder in the first degree, 116 counts of criminal attempt to commit murder. >> reporter: the courtroom was filled with family members and victims still recovering from their wounds. holmes opened fire inside a colorado movie theater murdering 12 people. >> we're not going to back down for this individual. we're not going to let his fears stop our lives. >> reporter: the 24-year-old appeared subdued and at times dazed and still has that orange hair from last week. holmes spoke one time saying yes when asked if he understood the charges. holmes was charged with murder with motivation. holmes was reportedly seeing a psychiatrist and the defense wants anything taken returned. >> it was very important today to come and see him. there was a lot of anger. >> reporter: holmes is scheduled to be back in court in august. he could face the death penalty if convicted. edward lawrence, wjz. >> the judge has placed a gag order on the attorney who are handling the case. >>> a woman is recovering after being attacked

which will cost the university another $13 million. >>> colorado massacre suspect james holmes appeared in court. teresa garcia has the latest from aurora colorado. >> reporter: james holmes had brightly died hair and appeared to be dazed at his first court appearance since the deadly massacre at a colorado movie theater. >> you have a right to remain silent. >> reporter: the suspected gunman refused to look at the judge while he was read his rights. several times it looked like the 24-year-old was nodding off. >> you're currently being held on a no bond hold. >> reporter: prosecutors say they did not know whether holmes was on medication. they were given until next monday to file formal charges. >> there's no such thing as a slam dunk case. it is a case where we're still looking at the enormous amount of evidence. >> reporter: the district attorney said her office will consider pursuing the death penalty. and consult with the families of the victims before making that decision. family members of several victims were in court during the hearing. some said they just wanted to see the sus

. >> reporter: aurora police refused to comment on reports that the suspect, 24-year-old james holmes, had his hair painted red and called himself the joker. police said it was dressed head to toe in body armor and wore a gas mask during the attack. jennifer seeger says the suspect pointed a gun directly at her face. >> i just jumped forward into the aisle and curled into a ball and waited for him to go up the stairs. >> reporter: holmes fired an assault rifle, a shotgun, and at least one handgun during the attack. some of those shots went through the walls into another theater. a man in a blood-soaked shirt and a child in a batman costume were among hundreds who made it out alive. corbin dates was sitting in the second row. >> i felt the caps from the bullet burn my leg. >> reporter: the university of colorado confirms holmes was dropping out of a graduate program in neuro science. police find explosives in his car and his nearby apartment. >> his apartment is booby trapped with various incendiary and chemical devices and apparent trip wires. >> reporter: survivors include a 3-month-old baby.

james holmes burst into that theater and opened fire. in addition to the 12 killed, dozens of other people were injured. some of them still in the hospital tonight. and that tragedy in aurora, once again raising questions about gun control in america. it comes as a federal judge here in baltimore finds part of a state gun law unconstitutional. that means it could soon be easier to carry a concealed weapon here in maryland. [ gunshot ] >> reporter: a victory for opponents of gun control in maryland. a judge issued a ruling that affects maryland's concealed carry permit law. until now, they had to have a substantial reason for a permit. but that has been struck down. >> even without this good and substantial showing, we still have one of the most restrictive regimes in america, in maryland here, for getting a permit for getting a gun. >> reporter: attorney hamsil reports a man who was denied. this new law does not require background checks or fingerprinting. >> this ruling would only affect law-abiding citizens, people who have been found and investigated to be found law abiding and h
